What is the difference between DUI & OUI?

DUI charges are brought against individuals when they are accused of driving a motorized vehicle under the influence. Remember, you don't have to be driving in order to be charged. Simply operating a motor vehicle while under the influence (OUI) is also against the law and can result in serious charges.

Driving under the influence:

Driving under the influence also has different classifications. The first offense is typically considered a misdemeanor. Subsequent DUIs or those that result in injury or death can be charged as felonies. DUIs often result in fines, license suspension, and imprisonment.

  • First & Second offense: can be up to 72 hours in jail, fines up to $1,500, and a driver's license suspension of 90 days.
  • Third offense: A third DUI offense within 10 years of two prior DUI convictions is considered a Class C felony, with up to five years in prison, fines up to $10,000, and a driver's license revocation of at least three years.
  • Fourth offense or more: A fourth DUI offense or more within 10 years of three prior DUI convictions is considered a Class B felony, with up to 10 years in prison, fines up to $25,000, and a driver's license revocation of at least five years.
